Terms of Service

1. Agreement to Terms

By accessing or using the OutfitScore service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and OutfitScore.

2. The Service

OutfitScore provides an AI-powered analysis of fashion, style, and makeup based on images you upload. The Service is for personal, non-commercial use only.

3. User Accounts

You must be at least 16 years old to create an account. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. User-Generated Content (Your Images)

You retain all ownership rights to the images you upload to the Service ("User Content"). However, by uploading User Content, you grant OutfitScore a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, and analyze your User Content solely for the purpose of:

• Providing the analysis service to you.
• Improving and training our AI models. (For this purpose, your images will be anonymized and disassociated from your personal account).

You represent and warrant that you own or have the necessary rights and permissions to upload your User Content and to grant us the license described above. You agree not to upload any content that is illegal, defamatory, or infringes on the intellectual property or privacy rights of others.

5. Acceptable Use Policy

You agree not to use the Service to:

• Upload any content that contains nudity, violence, or is otherwise offensive or inappropriate.
• Upload images of other people without their explicit consent.
• Violate any applicable laws or regulations.
• Attempt to disrupt or compromise the integrity or security of the Service.

We reserve the right to remove any content and terminate accounts that violate these rules.

6. Subscriptions and Billing

Billing: Paid plans ("Premium", "Pro") are billed in advance on a recurring monthly basis. By purchasing a subscription, you authorize us to charge your payment method automatically each month.

Automatic Renewal: To ensure uninterrupted service, your subscription will automatically renew at the end of each billing period. We will notify you if there are any changes to the pricing.

Cancellation: You can cancel your subscription at any time from your user dashboard. The cancellation will take effect at the end of your current billing period. You will retain access to paid features until then. No partial refunds will be provided.

Refunds: All payments are non-refundable unless required by law. If you believe there has been a billing error, please contact our support.

7. Copyright Policy (DMCA)

OutfitScore respects the intellectual property rights of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information in writing:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the material that is claimed to be infringing and where it is located on the Service.
4. Your contact information, including address, telephone number, and email address.
5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including for a breach of these Terms.

You may terminate your account at any time by using the "Delete Account" feature in your dashboard.

9. Limitation of Liability

To the fullest extent permitted by law, OutfitScore shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

10. Governing Law

These Terms shall be governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
