Terms of Service

1. Agreement to Terms

By accessing or using the OutfitScore service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and SSDevProject.

2. The Service

OutfitScore provides an AI-powered analysis of fashion, style, and makeup based on images you upload. The Service is for personal, non-commercial use only.

Usage limits. Free access includes a limited number of analyses. These limits are set at our discretion, may differ between users and sessions, and may change at any time without notice. Paid plans include the allowances described on the pricing page at the time of purchase.

3. User Accounts

You must be at least 16 years old to create an account. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. User-Generated Content (Your Images)

You retain all ownership rights to the images you upload to the Service ("User Content"). However, by uploading User Content, you grant OutfitScore a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, store, and analyze your User Content solely for the purpose of:

• Providing the analysis service to you.
• Storing the image with our image host so we can show you your result in the dashboard.
• Improving and training our AI models. (For this purpose, your images will be anonymized and disassociated from your personal account).

Uploaded images are stored with our image host (Cloudinary). Delivery URLs are not listed in a public gallery (the public lookbook was retired), but anyone who obtains the URL can open the file. Do not upload anything you are not willing to have stored that way.

You represent and warrant that you own or have the necessary rights and permissions to upload your User Content and to grant us the license described above. You agree not to upload any content that is illegal, defamatory, or infringes on the intellectual property or privacy rights of others.

5. Acceptable Use Policy

You agree not to use the Service to:

• Upload nudity, pornography, or sexual content, including exposed genitalia, buttocks, or female breasts/nipples, or images of sexual acts. Lingerie, underwear, or swimwear worn as clothing may be analyzed privately; they must not be posted as public content and must not depict a minor.
• Upload any image of a person who appears to be under 18. This includes fashion, makeup, and body photos. We will delete such content and may report it to the authorities where required by law.
• Upload images of other people without their explicit consent. You are solely responsible for having that consent before you upload.
• Upload violence, gore, hate symbols, or other illegal content.
• Violate any applicable laws or regulations.
• Attempt to disrupt or compromise the integrity or security of the Service.

We may refuse, hide, or delete User Content, disable public display, and suspend or terminate accounts that violate these rules. Automated filters can miss content. A ToS rule is not a substitute for upload-time blocking; if prohibited content is stored, we will remove it when we become aware of it.

If you believe User Content depicts you without consent, email [email protected] with the URL or account details. We will review and remove it where required.

6. Subscriptions and Billing

Billing: Paid plans ("Premium", "Pro") are billed in advance on a recurring monthly basis. By purchasing a subscription, you authorize us to charge your payment method automatically each month.

Automatic Renewal: To ensure uninterrupted service, your subscription will automatically renew at the end of each billing period. We will notify you if there are any changes to the pricing.

Cancellation: You can cancel your subscription at any time from your user dashboard. The cancellation will take effect at the end of your current billing period. You will retain access to paid features until then. No partial refunds will be provided.

Refunds: You may request a full refund within 14 days of your initial purchase or renewal. To request a refund, please contact our support at [email protected].

7. Copyright Policy (DMCA)

SSDevProject respects the intellectual property rights of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please provide our Copyright Agent with the following information in writing:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
2. Identification of the copyrighted work claimed to have been infringed.
3. Identification of the material that is claimed to be infringing and where it is located on the Service.
4. Your contact information, including address, telephone number, and email address.
5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
6. A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including for a breach of these Terms.

You may terminate your account at any time by using the "Delete Account" feature in your dashboard.

9. Limitation of Liability

To the fullest extent permitted by law, SSDevProject shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

10. Governing Law

These Terms shall be governed by the laws of the State of California, United States, without regard to its conflict of law provisions.
